Acceptance of These Terms
These Terms of Use (“Terms”) are a binding agreement between you and A Novel Therapy, LLC (“A Novel Therapy,” “we,” “us,” or “our”). They govern your access to and use of anoveltherapy.com, our digital courses, our online book clubs, and any other content or services offered through the site (collectively, the “Services”).
By accessing or using the Services, by purchasing a course or subscription, or by clicking to accept these Terms, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy and Disclaimer, each of which is incorporated by reference. If you do not agree, you must not use the Services.
The Services are available only to users who are 18 years of age or older. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.
Educational Nature of the Services — Not Therapy or Clinical Care
This is the most important provision in these Terms. Please read it carefully.
A Novel Therapy provides educational content and literary analysis. It is not therapy, counseling, mental health treatment, medical care, or any other regulated clinical or healthcare service. Your use of the Services does not create a therapist–client, clinician–patient, doctor–patient, or any other professional or fiduciary relationship between you and A Novel Therapy, LLC, Dr. Kerry Doyle, or any other contributor.
Dr. Kerry Doyle is a Licensed Independent Clinical Social Worker (LICSW) licensed in the States of Rhode Island, Florida, and Massachusetts. Her clinical practice is conducted through a separate professional entity. The Services offered through A Novel Therapy, LLC are not provided as the practice of clinical social work, psychotherapy, counseling, or any other regulated mental health profession in any jurisdiction. No licensee–client relationship is created by your participation in the Services. References to Dr. Doyle’s clinical credentials are biographical only and identify the source of the educational analysis; they do not indicate that clinical services are being delivered.
The Services discuss psychological concepts using fictional characters and stories. The Services are not, and must not be used as, a substitute for individualized professional mental health, medical, or psychiatric assessment, diagnosis, or treatment. If you are experiencing emotional, psychological, or medical concerns of any kind, consult a licensed professional in your jurisdiction.
By accessing or using the Services, you specifically acknowledge and agree that:
1. You are not entering into any therapeutic or clinical relationship with Dr. Kerry Doyle or A Novel Therapy, LLC;
2. No statement made through the Services — whether in a course module, video, written content, book club session, chat exchange, comment, email response, or otherwise — constitutes therapy, counseling, diagnosis, treatment, or individualized professional advice;
3. The Services are educational in nature, and any decisions you make about your own mental health, relationships, life circumstances, or medical care are your own responsibility, made with the advice of a licensed professional of your choosing where appropriate;
4. You will not rely on the Services as a substitute for care from a qualified, licensed professional with knowledge of your specific situation.
Crisis Resources
The Services are not intended for use in a mental health emergency. If you are experiencing a mental health crisis, thoughts of self-harm or harm to others, or any situation requiring immediate help, contact emergency services immediately:
In the United States: Call or text 988 (Suicide & Crisis Lifeline), or call 911.
Outside the United States: Contact your local emergency services or crisis line.
A Novel Therapy does not provide crisis response, emergency intervention, or real-time mental health support.
Book Club Participation and Conduct
Our live book clubs are interactive educational sessions conducted by livestream with audience interaction through chat. Participation in the book clubs is subject to the following rules:
5. Educational analysis only. Book club discussions focus on fictional characters and themes from the books being analyzed. They are not group therapy, peer support groups, processing groups, or any other clinical or support service.
6. No individualized clinical guidance. Dr. Doyle and any other contributor will not provide diagnoses, treatment recommendations, clinical interpretations of your personal circumstances, or any other individualized clinical service in the book club or in any chat, comment, direct message, or email exchange. Questions seeking individualized clinical guidance will not be answered substantively; you will be directed to seek help from a licensed professional in your jurisdiction.
7. Chat conduct. Chat is for questions and observations about the books and concepts being discussed. Participants are asked to keep chat focused on the literary and educational content of the session; to avoid sharing identifying personal information, trauma narratives, or detailed mental health histories in chat; to be respectful of other participants; and to refrain from offering clinical advice, diagnoses, or therapeutic recommendations to other participants.
8. Crisis resources posted each session. Crisis line and emergency contact information will be posted at the beginning of every live session. Anyone in distress is strongly encouraged to use those resources rather than the chat.
9. No recording or redistribution. Participants may not record, screen-capture, screen- share, transcribe, or otherwise reproduce any live book club session, in whole or in part, without our express prior written consent. Any unauthorized recording or redistribution will result in termination of access without refund and may be subject to legal action.
10. Moderation. We reserve the right to remove any participant from any session, suspend or terminate any account, and delete any chat content, at our sole discretion, with or without notice, for any conduct we determine is inconsistent with these Terms or the educational purpose of the Services.
Account Registration and Security
To access certain Services, you may be required to create an account. You agree to provide accurate, complete, and current information and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You may not share, transfer, or sell access to your account. Each account is for the personal, individual use of a single account holder.
Purchases, Subscriptions, and Refunds
Courses
Our digital courses are sold for a one-time fee.All course sales are final. Once you have been granted access to a course, no refunds will be issued except where required by applicable law.
Book club subscriptions
Our book clubs are offered through monthly recurring subscriptions. By subscribing, you authorize us (or our payment processor on our behalf) to charge your payment method monthly until you cancel. You may cancel at any time through your account settings or by contacting us; cancellation takes effect at the end of the current billing period. We do not issue refunds or pro-rated credits for partial months once a billing period has begun, except where required by applicable law.
Payment processing
All payments are processed by third-party payment processors. We do not store full credit card numbers on our systems.
Price changes
We may change the price of any course or subscription at any time. Price changes to existing subscriptions will take effect at the next renewal and will be communicated to you in advance.
Intellectual Property
Our content
All content created by or for A Novel Therapy — including course videos, written materials, downloadable resources, the website, the A Novel Therapy name and logo, and any compilations of the foregoing — is the property of A Novel Therapy, LLC or our licensors, and is protected by United States copyright, trademark, and other intellectual property laws.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services and our content solely for your own personal, non-commercial educational use. You may not copy, reproduce, distribute, modify, create derivative works of, publicly display, publish, transmit, reverse-engineer, sublicense, sell, or otherwise commercially exploit any of our content without our prior written consent.
Third-party content (fair use)
Our content includes references to, quotations from, and analysis of books and other creative works that are the property of their respective copyright holders. Our use of those works is intended to qualify as fair use under 17 U.S.C. § 107 for purposes of commentary, criticism, education, and transformative analysis. We do not claim ownership of any third-party work. We do not reproduce full works, distribute copyrighted texts, or substitute for the original materials. We encourage all participants to purchase or otherwise legally access the original works through authorized channels.
If you are a copyright owner and believe your work has been used in a manner that constitutes infringement, please contact us at the email address below and we will promptly address your concerns.
Submissions
Any feedback, ideas, suggestions, or other content you submit to us (other than personal information governed by our Privacy Policy) is non-confidential and non-proprietary. You grant us a perpetual, royalty-free, worldwide license to use it for any purpose without compensation to you.
Prohibited Conduct
You agree not to:
Use the Services for any unlawful purpose or in violation of any applicable law;
Record, screen-capture, transcribe, copy, or redistribute any course content or live session content without our prior written consent;
Share your account credentials or permit any other person to access the Services through your account;
Reverse-engineer, decompile, or attempt to derive source code from any part of the Services;
Use any automated means (bots, scrapers, etc.) to access the Services;
Use the Services to harass, defame, threaten, or harm any other person;
Provide false information in connection with your account or any transaction;
Interfere with the security or operation of the Services.
We may terminate your access to the Services at any time, without notice, for any conduct we determine violates these Terms or is otherwise harmful to us, other users, or third parties.
Affiliate Disclosure
A Novel Therapy participates in the Amazon Services LLC Associates Program. If you click an Amazon link on our site and make a purchase, we may receive a small commission at no additional cost to you. We only recommend books we believe are valuable to the educational content we provide.
Disclaimers
The Services and all content provided through them are made available on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant that any information provided through the Services is accurate, complete, current, or applicable to your particular situation.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL A NOVEL THERAPY, LLC, DR. KERRY DOYLE, OR ANY OF OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
Assumption of Risk and Release
You acknowledge that any decisions you make in response to your engagement with the Services are made at your own risk. You release A Novel Therapy, LLC, Dr. Kerry Doyle, and our employees, contractors, and agents from any and all claims arising from your reliance on or use of the Services, to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless A Novel Therapy, LLC, Dr. Kerry Doyle, and our officers, directors, employees, contractors, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of any other person or entity; or (d) any content you submit through the Services.
Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Rhode Island, without regard to its conflict- of-laws principles.
You agree that any claim or dispute arising out of or relating to these Terms or the Services shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its applicable rules. The arbitration shall take place in Providence, Rhode Island, or by video/teleconference at our discretion. You waive any right to a jury trial and any right to participate in a class action or class arbitration. You agree to bring any claim solely in your individual capacity. If any claim cannot be arbitrated under applicable law, the exclusive jurisdiction and venue for that claim shall be the state or federal courts located in Providence County, Rhode Island.
International Users
The Services are operated from the United States. If you access the Services from outside the United States, you are responsible for compliance with the laws of your jurisdiction. You may not use the Services in any country or manner prohibited by applicable law.
Changes to These Terms
We may revise these Terms from time to time. The most recent version will be posted on our website with an updated Effective Date. Your continued use of the Services after changes are posted means you accept the revised Terms. We will notify you of material changes through reasonable means.
Miscellaneous
These Terms (together with the Privacy Policy and Disclaimer) constitute the entire agreement between you and us regarding the Services and supersede all prior or contemporaneous communications. If any provision of these Terms is held to be unenforceable, the remainder will continue in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign or transfer these Terms; we may assign these Terms at any time.
